Our mission is to create and make available services and products that enable people get work opportunities irrespective of their geographical location. To enable people to participate and claim jobs and work opportunities from wherever they are. To create products and services that help in people getting equal opportunities. To make the best people available and accessible to the Industry for hiring and provide equal opportunities irrespective of geographical location. To enable seamless participation virtually online in work opportunity distribution. We encourage equal participation of the Industry and the people seeking opportunities on our platforms. We consider our marketplace model is the best way to offer our services. We need rules to keep our platforms and services safe for you, for us, for the industry and overall, for everyone who uses our services and platforms. By agreeing to these terms, you agree to resolve disputes with GC through binding arbitration (with extremely limited expectations, not in court), and you waive certain rights to participate in class actions, as detailed in Dispute Resolution section. These are terms and conditions governing the use of https://opt.growthcode.in (the website” and OPT (mobile app) and the agreement that operates between us and you (the terms). The website is owned and operated by GC (us/our/we) and these Terms set out the rights and obligations of all users (you/your) in relation to your use of our website and mobile apps. Please red these terms and our privacy statements carefully. By using the website and or app, you are consenting to be bound by the current terms and our privacy statement. We may revise the terms and information contained on the website and app at anytime and without notice. If you do not agree to these Terms or other conditions, please refrain from using our website and apps.

We collect information listed below for providing you the services we offer. Information here refers to any information that relates to or can be identified with a natural person such as name, identification number, location, physical, economic, cultural, and or social identity. How we use or disclose your information is determined by how you engage with us and use our services and products and for what purpose

The information we collect and how we use it is listed below

  • name, email address, password, country, city, contact number and company/organization that you are associated with, when you sign up for alerts on the Platform.
  • information usually included in a resume /curriculum vitae like name, contact details including email address and mobile number, work experience, educational qualifications, data relating to your current and past remuneration or salary, a copy of your resume, etc. when you register on the Platform in text and or audiovisual formats/mediums
  • information about how you use our services and products, preferences and other such information to make the experience better.
  • we may collect your personal information with your consent, as part of surveys we may occasionally conduct or as part of a schedule
  • information about your communication and any information you choose to provide when you communicate with GC to share with our partners
  • we may use cookies to automatically collect, store and use technical information about your system and interaction with our Platform
  • we may collect technical or other related information from the device as well as the device location when you use a device like smartphone, tablet, laptop or computer to access our website of platform,
  • We may record your conversations in audio, audio-visual, text formats to the extent allowed by law for legal purposes and for future references depending when you use a device to access the Platform,

We will only use your personal data in a fair and reasonable manner, and where we have a lawful reason to do so.

Our use of your personal data depends on the purpose for which you interact with us. We may process your Personal Information for the following purposes:

  • For communicating with you and intimating you of our services and products such as events, surveys, new offers, features, job alerts, job recommendations, and other such information
  • For safeguarding our users, to provide you with additional support
  • To improve our services and your user experience, to improve the quality of our services and products. We do not intend to associate with identifiers from cookies or similar technologies with sensitive categories. Example: cookies based on race, religion, orientation, health etc.
  • To conduct surveys, market research etc.to improve our products and services

  • To detect, investigate, act, prevent crimes (including but not limited to fraud and other financial crimes), any other illegal activities, suspected fraud, or violations of GC’s terms of use.
  • To verify identify as per government sanctions, orders or prescriptions and general and specific due diligence
  • To seek professional or legal counsel /advise in relation to any legal proceedings for establishing, exercising or defending our rights

Your Account with us – Candidates/Job seekers

 

You will need to create an account to sign up, enroll, subscribe and do most of the activities on OPT. Should you suspect your account is being used by someone else, please let us know immediately by contacting our Support Team by writing to askus@growthcode.in By signing up to OPT you agree and declare that you are of the age of consent for using online services in your country

  • You agree that the information you provide at the time of signing up, enrolling, subscribing to OPT services, uploading your audio-visual and text resumes, answering assessments and doing other activities on GC’s recruitment platforms is accurate and complete. You agree that you will continue to provide accurate and complete information.
  • You agree that you are completely responsible for your account with us. You are fully responsible for everything that happens on your account, including for any harm or damage (to us or anyone else) caused by someone using your account without your permission.
  • You agree that you will be careful with your passwords and that you will not transfer your account to anyone else
  • You agree that you will not log into our platform using someone else’s login credentials and you are fully responsible for what happens to you or any damage caused to us or anyone else when you have logged into our platform using someone else’s username and password without their permission. · You agree and understand that we will not provide you with anyone else’s login credentials without their permission.
  • You agree that you are responsible for what happens to you or any damage caused to us, to you or anyone else when someone else with who you have shared your login credentials logs in with or without your permission
  • You agree to contact our support team immediately if you suspect that your login credentials have been stolen and or is being used by someone else.
  • You agree and understand that we will ask you for some information to reset your password / assign new password and other activities to confirm you are indeed the owner of the account.
  • You agree by signing up for OPT that you are 18 years of age, not a minor and are of legal age prescribed to be hired for work. or older to use our services. OPT restricts use of its services to people who are 18 years or older.
  • You agree that you are the parent / legal guardian of the student / learner and understand that you will be required to provide information about your relationship with the learner/user as and when required by us for authentication purposes/

Your Account with us – Industry Representative/panelist/administrator/evaluator

You will need to create an account to sign up, enroll, subscribe and do most of the activities on OPT. Should you suspect your account is being used by someone else, please let us know immediately by contacting our Support Team by writing to askus@growthcode.in By signing up to OPT you agree and declare that you are of the age of consent for using online services in your country

  • You agree that the information you provide at the time of signing up, enrolling, subscribing to OPT services, uploading your work opportunities, job vacancies in text, audio, visual formats, uploading your assessments, questions and assessments and any such information you provide is accurate and complete. You agree that you will continue to provide accurate and complete information.
  • You agree to provide us with information regarding the existence of the organization you run / work for / represent and information about your working status, employment, ownership or authority to legally represent the listed organization/firm/business and that all such information provided by you is true and accurate. That you will update any changes to all such information as and when there are any changes.
  • You agree that you are completely responsible for your account with us. You are fully responsible for everything that happens on your account, including for any harm or damage (to us or anyone else) caused by someone using your account without your permission.
  • You agree that the job vacancies, jobs and work opportunities you list/mention/advertise on our platforms are legitimate, complete, accurate and legal.
  • You agree and state that you will not download resumes/video profiles and other such information without entering prescribed service/product engagement with us
  • You agree and state you will not misuse the content/information/video resumes and other such information available on our platforms for any other use other than for recruiting, training, assessment, feedback and organizational development.
  • You agree that you will not share resumes/profiles/ video resumes and any such information with anyone who is not a party to the working engagement or anyone who is not registered on the platform representing your company/organization. You will not share any information on the platform for any purpose other than recruitment, hiring, interviewing, training, assessment and feedback
  • You agree that you / your nominated users like evaluators / panelists will refrain from making personal comments, using unacceptable language or any such unacceptable gestures including the choice of words, your clothing or background images / videos if any while interacting with candidate or any other user on the platforms
  • You agree to delete the jobs/work opportunities/job vacancies from our platforms once they are no longer live.
  • You agree to send us the list of candidates selected from our portals and platforms with or without our special/specific engagement
  • You agree that you will be careful with your passwords and that you will not transfer your account to anyone else
  • You agree that you will not log into our platform using someone else’s login credentials and you are fully responsible for what happens to you or any damage caused to us or anyone else when you have logged into our platform using someone else’s username and password without their permission.
  • You agree and understand that we will not provide you with anyone else’s login credentials without their permission.
  • You agree that you are responsible for what happens to you or any damage caused to us, to you or anyone else when someone else with who you have shared your login credentials logs in with or without your permission
  • You agree to contact our support team immediately if you suspect that your login credentials have been stolen and or is being used by someone else.
  • You agree and understand that we will ask you for some information to reset your password / assign new password and other activities to confirm you are indeed the owner of the account.
  • You agree by signing up for OPT that you are 18 years of age, not a minor and are of legal age prescribed to be hired for work. or older to use our services. OPT restricts use of its services to people who are 18 years or older.
  • You agree that you are the parent / legal guardian of the student / learner and understand that you will be required to provide information about your relationship with the learner/user as and when required by us for authentication purposes/

Your Account with us – Sourcing Partners AND Strategic Business Partners

  • Your Partnership account will be created on GC’s recruitment platforms for a period of 1 year. The partnership shall be renewed every year before or at the end of the term of agreement.
  • Your company / institution’s name shall be made available for the candidates as a drop down menu option to choose from at the time of their registration for a period of 1 year from the date of contract or their first job offer and joining GC’s clients – which ever happens first. You will be given an access on the platforms to check the status of the candidates sourced from you for the duration of the agreement
  • You agree to allow and provide space for GC to advertise job vacancies and work opportunities and other recruitment events like job fests, etc. as and when they happen.
  • You agree to allow GC to screen and assess candidates for determine their job/work opportunity fitment
  • You agree that you will not disclose or share any information regarding jobs/opportunities and any such sensitive information implied and expressly marked as sensitive and confidential.
  • You shall not use the platforms of GC for any purpose other than fulfilling the purpose of the agreement with GC at any time for any reason whatsoever without the written permission of GC

Abuse

Users have a requirement to treat every person with respect. Users must not make any comments towards other users that:

1) Contain any material which is defamatory of any other person

2) Breach the data protection or privacy rights of any person

3) Contain any material which is obscene, offensive, hateful or inflammatory

4) Promote sexually explicit material

5) Promote violence

6) Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age

7) Infringe any patent, copyright, database right, trademark or other intellectual property right of any other person

8) Is likely to deceive any other person

9) Is made in breach of any legal duty owed to a third party, such as contractual duty or a duty of confidence

10) Promote any illegal activity

11) Is threatening, abusive or invades into another’s privacy, or causes annoyance, inconvenience or needless anxiety

12) Is likely to harass, upset, embarrass, alarm or annoy any other person

13) Is used to impersonate any person, or to misrepresent your identity or affiliation with any person

14) Gives the impression that they emanate from us if this is not the case; or

15) Advocates, promotes or assists any unlawful act such as (by way of example only) copyright infringement or computer misuse.

Using OPT at Your Own Risk

OPT enables anyone anywhere to create and share profiles and publish resumes/job applications/job vacancies/work opportunities. Our platform model means we do not review or edit the content /information/claims for legal issues, and we are not able to determine the legality /accuracy/correctness or completeness of the information/posts/listings and resumes/candidature. We do not exercise any editorial control over the courses that are available on the platform and, as such, do not guarantee in any manner the reliability, validity, accuracy or truthfulness of the job postings/job vacancies/ opportunities/ candidate profiles. you rely on any information provided by an instructor at your own risk.

By using the Services, you may be exposed to content that you consider offensive, indecent, or objectionable. OPT has no responsibility to keep such content from you and no liability for your access or enrollment to the extent permissible under applicable law. You acknowledge the inherent risks and dangers in the strenuous nature of these types of courses, and by enrolling in such platforms; you choose to assume those risks voluntarily, including risk of illness, bodily injury, disability, or death. You assume full responsibility for the choices you make before, during and after your enrollment to the platforms.

You shall not communicate directly with candidates/recruiting organizations/ recruiters /candidates /panelists. Any such act may render your account with us stopped and all permissions revoked and lead to relevant legal actions.

We are not responsible for the interactions/the consequences arising out of such interactions between candidates/recruiters/industry representatives/evaluators/mentors and administrators. All such interactions, legality, conformity, adherence to prescribed formats, methods and restrictions and permissions and the consequences arising from them are the responsibility of the people interacting other than interactions for the purpose for which the platforms are built/offered and used.

When you use our Services, you will find links to other websites that we do not own or control. We are not responsible for the content or any other aspect of these third-party sites, including their collection of information about you. You should also read their terms and conditions and privacy policies.

How Do We Keep Your Information Secure?

OPT takes appropriate security measures to protect against unauthorized access to, or unauthorized alteration, disclosure or destruction of, data that You share, and We collect and store. Unfortunately, however, no system can be 100% secured, and We cannot guarantee that communications between You and OPT, the Services, or any information provided to Us in connection with the information We collect through the Services will be free from unauthorized access by third parties. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of User information at any time. Your password is an important component of Our security system. As such, it is Your responsibility to protect it. Do not share Your password with any third parties. If Your password has been compromised for any reason, you should change it immediately and contact us at askus@growthcode.in for any concerns.

GC’s Rights

 

We own the OPT platform and Services, including the website, present or future apps and services, and things like our logos, API, code, and content created by our employees. You cannot tamper with those or use them without authorization.

All right, title, and interest in and to the GC platforms and Services, including our Logos, trademarks, temporary marks and all other such designs and contents, our website, our existing or future applications, our APIs, databases, and the content our employees or partners submit or provide through our Services (but excluding content provided by instructors and students) are and will remain the exclusive property of GC and its licensors. Our platforms and services are protected by copyright, trademark, and other laws of both INDIA and foreign countries. Nothing gives you a right to use the GC name or any of the GC trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding GC or the Services is entirely voluntary, and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.

You may not do any of the following while accessing or using the GC platforms and Services:

  • access, tamper with, or use non-public areas of the platform, GC’s computer systems, or the technical delivery systems of GC’s service providers.
  • disable, interfere with, or try to circumvent any of the features of the platforms related to security or probe, scan, or test the vulnerability of any of our systems.
  • copy, modify, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code of or content on the GC platforms or Services.
  • access or search or attempt to access or search our platform by any means (automated or otherwise) other than through our currently available search functionalities that are provided via our website, mobile apps, or API (and only pursuant to those API terms and conditions). You may not scrape, spider, use a robot, or use other automated means of any kind to access the Services.
  • in any way use the Services to send altered, deceptive, or false source-identifying information (such as sending email communications falsely appearing as GC); or interfere with, or disrupt, (or attempt to do so), the access of any user, host, or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the platforms or services, or in any other manner interfering with or creating an undue burden on the Services.

Miscellaneous Legal Terms

8.1 Binding Agreement

You agree that by registering, accessing or using our Services, you are agreeing to enter a legally binding contract with GC. If you do not agree to these Terms, do not register, access, or otherwise use any of our Services.

If you are a candidates/industry representative/administrator/panelist/evaluator, accepting these Terms and using our Services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so.

Any version of these Term in a language other than English is provided for convenience and you understand and agree that the English language will control if there is any conflict.

These Terms (including any agreements and policies linked from these Terms) constitute the entire agreement between you and us.

If any part of these Terms is found to be invalid or unenforceable by applicable law, then that provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms will continue in effect.

Even if we are delayed in exercising our rights or fail to exercise a right in one case, it does not mean we waive our rights under these Terms, and we may decide to enforce them in the future. If we decide to waive any of our rights in a particular instance, it does not mean we waive our rights generally or in the future.

The following sections shall survive the expiration or termination of these Terms: Registration/Enrollment and Access, GCs Rights to Content You Post, Using GPAA at Your Own Risk, GC’s Rights, Miscellaneous Legal Terms, and Dispute Resolution

Disclaimers

It may happen that our platform is down, either for planned maintenance or because something goes down with the site. It may happen that one of our mentors/producers is making misleading statements in their course. It may also happen that we encounter security issues. These are just examples. You accept that you will not have any recourse against us in any of these types of cases where things do not work out right. In legal, more complete language, the Services and their content are provided on an “as is” and “as available” basis. We (and our affiliates, suppliers, partners, and agents) make no representations or warranties about the suitability, reliability, availability, timeliness, security, lack of errors, or accuracy of the Services or their content, and expressly disclaim any warranties or conditions (express or implied), including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We (and our affiliates, suppliers, partners, and agents) make no warranty that you will obtain specific results from use of the Services. We may decide to cease making available certain features of the Services at any time and for any reason. Under no circumstances will GC or its affiliates, suppliers, partners or agents be held liable for any damages due to such interruptions or lack of availability of such features.

We are not responsible for delay or failure of our performance of any of the Services caused by events beyond our reasonable control, like an act of war, hostility, or sabotage; natural disaster; electrical, internet, or telecommunication outage; or government restrictions.

Limitation of Liability

The material contained within the Services/courses on the Website is provided without any guarantees, conditions or warranties as to its accuracy. GC does not represent that information contained on or available via the Website is accurate or complete and accordingly it should not be relied on as such. You should not rely on any such information. Any arrangements made between you and any other person, using or named on the Website are entirely at your sole risk and responsibility.

To the extent permitted by law, we, and third parties connected to us hereby expressly exclude:

1) all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

2) any liability for loss or damage incurred by any user in connection with the use, inability to use, or results of the use of the Website, any websites linked to it and any material posted on it.

3) any liability for any bugs or faults in our systems or tools; and

4) any liability for any direct, special, indirect or consequential loss or damage incurred by any user in connection with the Website or in connection with the use, inability to use, or results of the use of the Website, any websites linked to it and any materials posted on it, including, without limitation any liability for:

i.loss of income or revenue.

ii.loss of business.

iii.loss of profits or contracts.

iv.loss of anticipated savings.

v.loss of data.

vi.loss of goodwill.

vii.wasted management or office time; and

viii.for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

Nothing in this section affects our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

In legal, more complete language, to the extent permitted by law, we (and our group companies, suppliers, partners, mentors and agents) will not be liable for any indirect, incidental, punitive, or consequential damages (including loss of data, revenue, profits, or business opportunities, or personal injury or death), whether arising in contract, warranty, tort, product liability, or otherwise, and even if we have been advised of the possibility of damages in advance. Our liability (and the liability of each of our group companies, suppliers, partners, and agents) to you or any third parties under any circumstance is limited to the amount of fees/consideration you may have paid us in the twelve (12) months before the event giving rise to your claims. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so some of the above may not apply to you.

Indemnification

If you behave in a way that gets us in legal trouble, we may exercise legal recourse against you. You agree to indemnify, defend (if we so request), and hold harmless GC, our group companies, and their officers, directors, mentors, suppliers, partners, and agents from an against any third-party claims, demands, losses, damages, or expenses (including reasonable attorney fees) arising from (a) the content you post or submit, (b) your use of the Services (c) your violation of these Terms, or (d) your violation of any rights of a third party. Your indemnification obligation will survive the termination of these Terms and your use of the Services.

Governing Law and Jurisdiction

These Terms are governed by the laws of India and the courts of Bangalore without reference to its choice or conflicts of law principles.

Legal Actions and Notices

No action, regardless of form, arising out of or relating to this Agreement may be brought by either party more than one (1) year after the cause of action has accrued.

Any notice or other communication to be given hereunder will be in writing and given by registered or certified mail return receipt requested, or email (by us to the email associated with your account or by you us (to the email associated with GC).

No Assignment

You may not assign or transfer these Terms (or the rights and licenses granted under them). For example, if you registered an account as an employee of a company, your account cannot be transferred to another employee. We may assign these Terms (or the rights and licenses granted under them) to another company or person without restriction. Nothing in these Terms confers any right, benefit, or remedy on any third-party person or entity. You agree that your account is non-transferable and that all rights to your account and other rights under these Terms terminate upon your death.

Dispute Resolution

Going to Arbitration

If we cannot resolve our dispute amicably, you and GC agree to resolve any claims related to these Terms (or our other legal terms) through final and binding arbitration, regardless of the type of claim or legal theory. If one of us brings a claim in court that should be arbitrated and the other party refuses to arbitrate it, the other party can ask a court to force us both to go to arbitration (compel arbitration). Either of us can also ask a court to halt a court proceeding while an arbitration proceeding is ongoing.

The Arbitration Process

Any disputes that involve a claim must be resolved exclusively through binding non-appearance-based arbitration. You and we agree that the following rules will apply to the proceedings: (a) the arbitration will be conducted by telephone, online, or based solely on written submissions (at the choice of the party seeking relief); (b) the arbitration must not involve any personal appearance by the parties or witnesses (unless we and you agree otherwise); and (c) any judgment on the arbitrator’s rendered award may be entered in any court with Bangalore jurisdiction.

No Class Actions

We both agree that we can each only bring claims against the other on an individual basis. This means: (a) neither of us can bring a claim as a plaintiff or class member in a class action, consolidated action, or representative action; (b) an arbitrator cannot combine multiple people’s claims into a single case (or preside over any consolidated, class, or representative action); and (c) an arbitrator’s decision or award in one person’s case can only impact that user, not other users, and cannot be used to decide other users’ disputes. If a court decides that this “No class actions” clause isn’t enforceable or valid, then this “Dispute Resolution” section will be null and void, but the rest of the Terms will still apply.

Changes

Notwithstanding the “Updating these Terms” section below, if GC changes this “Dispute Resolution” section after the date you last indicated acceptance to these Terms, you may reject any such change by providing GC a written notice of such rejection by mail or hand delivery to: Growthcode Technology Solutions Pvt Ltd, No 20, 9th Cross, KR Layout, 6th Phase, JP Nagar, Bangalore 560078, Karnataka, India, or by email from the email address associated with your Account to: askus@growthcode.in within 30 days of the date such change became effective, as indicated by the “last updated on” language above. To be effective, the notice must include your full name and clearly indicate your intent to reject changes to this “Dispute Resolution” section. By rejecting changes, you are agreeing that you will arbitrate any dispute between you and GC in accordance with the provisions of this “Dispute Resolution” section as of the date you last indicated acceptance to these Terms.

Updating These Terms

From time to time, we may update these Terms to clarify our practices or to reflect new or different practices (such as when we add new features), and GC reserves the right in its sole discretion to modify and/or make changes to these Terms at any time. If we make any material change, we will notify you using prominent means such as by email notice sent to the email address specified in your account or by posting a notice through our Services. Modifications will become effective on the day they are posted unless stated otherwise.

Your continued use of our Services after changes become effective shall mean that you accept those changes. Any revised Terms shall supersede all previous Terms.
